The above sales and delivery terms will be applied unless otherwise agreed in writing between Coloreurope C/O Grafisk-Handel and the buyer.
Coloreurope C/O Grafisk-Handel partner network may result in the buyer being sent his products from a country other than Denmark accompanied by a packing slip issued by the supplier in that country, even if the packing slip should contain sales and delivery conditions that differ from these conditions, the current Danish conditions must nevertheless apply in the relationship between Coloreurope C/O Grafisk-Handel and the buyer.

  1. Use

The following terms and conditions of sale and delivery (hereinafter referred to as "the terms") shall apply to the sale and/or supply of any service/product (hereinafter referred to as "the product" or "the service") from Color Europe C/O Grafisk-Handel to businesses, individuals, organisations and authorities (hereinafter referred to as "the customer"). The terms apply unless otherwise expressly and in writing are agreed between the customer and Color Europe C/O Grafisk-Handel , and regardless of whether the agreement is concluded via internet, webshop, email, telephone or otherwise. It is a prerequisite for the customer's purchase that these terms are accepted and the customer is encouraged to read the terms thoroughly.

  1. Information, conclusion of the contract, etc.

Any product information, as well as any information about technical data and functionality (e. g. performance, uptime, response time, etc. ) are for guidance only. The customer has full responsibility for selecting the item/service, including that the item/service can operate in the customer's intended operating environment. The customer's placing of orders requires creation as a customer in the Color Europe C/O Grafisk-Handel customer register. Any offer of goods/services, price information, etc. in sales literature, catalogues, etc. is only to be considered as an invitation to make offers, and is therefore not binding on Color Europe C/O Grafisk-Handel . The customer is encouraged to print the order confirmation immediately after receipt, as this may be relevant in connection with return or complaint. Invoices are sent when the item/service is shipped.

  1. Delivery and delivery time

The amount of the shipping fee depends on the mode of delivery chosen and may also vary if very large or very heavy products are purchased. Delivery is CIP (INCOTERMS). This means that Coloreurope C/O Grafisk-Handel takes care of the shipment and to insure the goods during transport. The delivery time depends on the size, nature of the order and what is otherwise agreed between the customer and Coloreurope C/O Grafisk-Handel . If, due to the customer's circumstances, delivery cannot be completed, the goods remain at the customer's expense and risk. Color Europe C/O Grafisk-Handel is entitled to charge storage rent, costs, etc. If, under these terms, the customer has the right to terminate the contract, this right of termination applies only to the delayed or defective part of the supply.

 

  1. Prices, handling costs and payment

4. 1 Prices
When you enter the webshop you can choose whether you want to shop as Private or Business.
Business:
If you choose to act as a business, all prices are excluding VAT, taxes and handling costs, etc.

Private:
If you choose to shop as private, prices are indicated by vat etc. Prices are daily prices and may vary from day to day.

Price error
If a price is manifestly incorrect and you reasonably should have discovered this, we are not required to deliver that product at the wrong price.
4. 2 Handling costs
Coloreurope C/O Grafisk-Handel primarily uses GLS for delivery, unless otherwise stated in the order confirmation.
4. 3 Payment
Payment can be made with the following payment cards: Dankort,Visa/Dankort, Visa, Mastercard and JCB. Color Europe C/O Grafisk-Handel uses a payment gateway that guarantees that all card data is sent encrypted and all card information provided is secured. This ensures you optimally, as there is no deductible in connection with any misuse of your card. Coloreurope C/O Grafisk-Handel agrees, after individual assessment of the customer's creditworthiness, to provide goods/services on credit to traders. Credit cannot be granted to private individuals. The customer cannot set off against the purchase price of claims arising from other legal matters, and the customer cannot exercise a right of restraining order or refuse payment due to delay, complaint or counterclaim regarding the specific delivery. Payment for ordered items is deducted only when the items are shipped from Color Europe C/O Grafisk-Handel warehouse or partner warehouse and first when all item on your order is shipped. No larger amount can ever be deducted than you have accepted when ordering your goods. You can also pay by bank transfer (prepayment), however, please note that you are not covered by the opposition scheme when paying by bank transfer.

4. 4 Late payment
In the late payment, interest on arrears equal to 2% per month and a reminder fee of EUR 20 per reminder are incurred. However, Coloreurope C/O Grafisk-Handel issues a maximum of three reminder letters before the claim is taken to debt collection.

  1. Retention of ownership

Coloreurope C/O Grafisk-Handel reserves ownership of the Item as long as full payment has not been received for the ordered item. Until ownership has been transferred to the customer, the sold property must be stored and maintained properly. Damage to the sold, in addition to what usual wear entails, must be replaced by the customer. The customer is also obliged to keep the sold fire, theft and water damage insured to its full value. The customer undertakes not to dispose of the sold in a manner that may impair Color Europe C/O Grafisk-Handel security in the goods, including but not limited to the pledge, rental or loan of the goods.

  1. Complaints and defects for business customers

The customer is obliged to carry out checks on the item/service immediately and no later than the day after receipt of a delivery and to check it for any defects. In the case of transport-damaged delivery, this must be rejected or received with reservations by annotating it on the terminal/consignment note, transport damage is external visible damage to the packaging. The customer is required to review and test software immediately after delivery.
Coloreurope C/O Grafisk-Handel can only be held responsible for correcting original defects in accordance with the relevant provisions of the Danish Sale of Goods Act.
If the customer finds defects, the customer must immediately advertise in writing to Coloreurope C/O Grafisk-Handel with specification of the defect being claimed.
If there is no timely advertising, the right to make defects has lapsed. In any case, the warranty period is limited to 12 months from delivery, however, so that the warranty period is 6 months from delivery in the case of mesh parts and batteries.
Thus, after the end of the complaint period, the customer cannot rely on the defect. For third-party products, the warranty period laid down in the warranty provisions applicable to the subcontractor applies. Exchange or repair does not result in a new 12-month complaint period. Coloreurope C/O Grafisk-Handel's liability for defects is always limited to either making remediation or replacement within a reasonable time, according to Coloreurope C/O Grafisk-Handel s's choice. Coloreurope C/O Grafisk-Handel is not responsible for defects due, among other things, to changes made by the customer, repairs performed by persons other than Coloreurope C/O Grafisk-Handel or Color Europe C/O Grafisk-Handel service partners, software related errors, data loss and lack of backup including in connection with repair, remediation and service, etc. , improper installation, processing, water damage, fire, unstable power supply, incorrect grid connection or typo due to the use of other connected equipment. No further warranty is provided by Coloreurope C/O Grafisk-Handel s unless expressly and in writing. Thus, warranty and service obligations, in addition to what may be expressly and in writing agreed with Coloreurope C/O Grafisk-Handel , are not the responsibility of Coloreurope C/O Grafisk-Handel , but of the manufacturer concerned and its service provider, if any,

  1. Complaint and defects for residential customers

When you shop with us as a consumer, the rules of the Danish Sale of Goods Act apply to purchases of goods. This means that you have a warranty for 24 months. If your complaint is justified, it means that you can either have the item repaired, exchanged, refunded or a reduction in the price, depending on the specific situation. You must advertise within a "reasonable time" after you discover the error. If you advertise within two months of the error being discovered, the complaint will always be timely. If the complaint is justified, we will refund your (reasonable) shipping costs. The goods must always be returned in safe packaging. Also, remember to get a receipt for shipping so that we can refund your shipping costs. We only receive packages that are sent directly to the address. When you return the item, please include a detailed description of the problem.

Right of withdrawal for private customers
As a consumer, you have 14 days right of withdrawal when you shop with us. The cooling-off period expires 14 days after the day you received your item. If you have ordered several different items in one order, but they are delivered individually, the deadline runs from the day you receive the last item. The deadline means that you have 14 days from receipt to notify us that you will regret your purchase. You can send an email to shop@coloreurope. eu or use the default performance form, which you'll find at the bottom of the terms of trade. You cannot undo the purchase by refusing to receive the item without notifying us at the same time.

Cancellation of part of the purchaseIf you have purchased several items from
us, you have the opportunity to send back one or more items even if they were purchased in one order. Please note that you will not receive a refund of the shipping costs if you cancel part of your purchase.

Return
Once you have notified us that you will regret your purchase, you have 14 days to send the item back to us. You have to pay for the package to be returned, and you are liable if an injury occurs during transport. Some items cannot be returned by normal courier. This applies to: Printers. The cost of returning these items is expected to cost a maximum of EUR 750 ex VAT.

The condition of the item when you returnit If the item has lost value and this is because you have used it in a different way than what was necessary to determine the
nature, characteristics and way of the item's operation, you can only get part of the purchase amount back. The amount you can get back depends on the commercial value of the item, and in some cases it can mean that you can only get the shipping costs back. We recommend that you return the item in the original packaging. If the original packaging is missing, it may result in an impairment of the item.

Refund of the purchase amount
If you cancel your purchase, you will get your money back. If the item is impaired, we deduct the amount you are liable for. We will refund all payments received from you, including delivery costs (except for additional delivery costs in cases where you have chosen a different mode of delivery than the cheapest form of standard delivery that we offer), no later than 14 days from the day we have received your notification that you will cancel the agreement. We will refund the money with the same means of payment that you used in the purchase, unless we have agreed otherwise. We may withhold payment until we have received the item, unless you send us documentation to have returned it.

Right of withdrawal in commercial purchases
There is no right of withdrawal in the case of sales to business. The return of goods can only be made by prior agreement between Coloreurope C/O Grafisk-Handel and the customer. Color Europe C/O Grafisk-Handel reserves the right to charge a fee to cover the costs of handling returned goods.

  1. Liability and liability limitations

Coloreurope C/O Grafisk-Handel is not liable in case of delay or defects in the item/service. Color Europe C/O Grafisk-Handel is only responsible as long as it follows from law. Coloreurope C/O Grafisk-Handel thus disclaims any liability for consequential and/or indirect losses including operating losses, profit losses, lost earnings, loss of data and/or other indirect losses, as well as costs related to restoration/updating, etc. due to defects in the sales. Color Europe C/O Grafisk-Handel product liability is limited to the liability arising from the Product Liability Act, and Coloreurope C/O Grafisk-Handel thus disclaims any liability for product damage on any other basis. The customer is obliged to notify Coloreurope C/O Grafisk-Handel in writing without undue delay if a product liability injury has occurred or that there is a risk that such damage will occur.

  1. Personal data

We need the following information when shopping with us:Name, address, tlf. nr. and email address. We record and disclose the personal data necessary to deliver the goods to you and inform you if unforeseen problems arise. In no case does Coloreurope C/O Grafisk-Handel disclose the customer's information to third parties unless the customer has accepted this. The personal data is registered with Coloreurope C/O Grafisk-Handel and stored for five years, after which the information is deleted. In addition, we cooperate with a number of other companies that store and process data. Companies only process information on our behalf and may not use it for their own purposes. We only work with data processors in the

EU or in countries that canprovide adequate protection for your information. The data controller at www. Coloreurope. eu is Coloreurope C/O Grafisk-Handel A/S. You have the right to know what information we process about you. If you think the information is inaccurate, you have the right to have it corrected. In some cases, we are obliged to delete your personal data if you request it. This could be, for example, if your data is no longer needed for the purpose for which we needed it.   1. Copyright and software licensing terms

The customer is at all times obliged to respect the licensing terms applicable to the supplying software and as set out in the manufacturer's/third-party supplier's applicable terms of use at any time. The customer is responsible for breach of these rights, including for unwarranted disclosure to third parties. The customer must exempt Coloreurope C/O Grafisk-Handel from any claim in connection with the customer's violation of the license terms.

  1. Force Majeure

If an extraordinary situation arises that is outside Coloreurope C/O Grafisk-Handel control and which under the Danish Sale of Goods Act must be considered force majeure, Color Europe C/O Grafisk-Handel obligations are suspended for the duration of the extraordinary situation. In such an extraordinary situation, the customer may terminate the agreement with Coloreurope C/O Grafisk-Handel if the situation lasts or is assumed to last longer than 60 days, and in those cases only with 14 days notice. Coloreurope C/O Grafisk-Handel cannot be held responsible for obstacles beyond our power, such as production disruptions, lightning strikes, prolonged power outages, strikes or other unforeseen events.

  1. Choice of law and venue

Any dispute between the customer and Coloreurope C/O Grafisk-Handel in connection with these terms is settled in accordance with Danish law before the Court of Copenhagen. The United Nations Convention on International Purchases Agreements (CISG) shall not apply.

  1. Nullity

If one or more provisions of these terms are deemed invalid, the other terms shall remain valid between the customer and Coloreurope C/O Grafisk-Handel .
